Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Calf Tracker Pro ("we," "our," or "us") governing your use of the Calf Tracker Pro mobile application, web dashboard, and associated services (collectively, the "Service").

If you do not agree to these Terms, you may not use the Service. By creating an account or using the Service in any way, you confirm that you are at least 13 years of age and have the legal authority to enter into this agreement.

2. Subscription Plans and Pricing

Calf Tracker Pro is offered on a subscription basis with the following plans:

Plan allowances are per farm user, not per device: Pasture and Starter include 1 farm user, Standard includes 3 farm users, and Pro includes unlimited farm users and farms. Exports are unavailable on Pasture, basic on Starter, and full CSV on Standard and Pro. All prices are in U.S. dollars and are subject to applicable taxes. Prices are accurate as of the date shown above and may change with notice. The current price displayed in the app or on the App Store at the time of purchase is the binding price.

Eligible new Pasture accounts receive 30 days of Pro access with no card required. At the end of 30 days, access returns to Pasture unless the customer explicitly chooses paid checkout. A paid plan renews for the selected monthly or annual period through its purchase channel until canceled.

3. Auto-Renewable Subscriptions (iOS)

Subscriptions purchased through the iOS App Store are managed by Apple and subject to Apple's payment terms.

• Billing: Payment is charged to your Apple ID account at confirmation of purchase.
• Renewal: Your subscription automatically renews at the end of each subscription period (monthly or annually) unless you cancel at least 24 hours before the renewal date.
• Cancellation: You can manage and cancel your subscription at any time through your Apple ID account settings in the App Store. Cancellation takes effect at the end of the current billing period — you retain access until then.
• Price changes: Apple provides notice of subscription price increases. For increases that require customer consent under Apple's current rules, Apple will request consent before renewal at the new price.
• Free trials: If a free trial is offered, unused portions of the trial are forfeited when you purchase a subscription.
• Restore purchases: Use the "Restore Purchases" option in the app to restore previously purchased subscriptions on the same Apple ID.

To manage your iOS subscription: open the App Store → tap your profile icon → Subscriptions → Calf Tracker Pro.

4. Web Subscriptions

Subscriptions purchased through calftrackerpro.com are processed securely via Stripe. Choosing a paid checkout starts the selected paid subscription; it does not start the free trial. Web subscriptions renew monthly or annually based on your selected plan until canceled through the Stripe customer billing portal. Cancellation is effective at the end of the current billing period.

5. Refunds

For subscriptions purchased through the iOS App Store, refund requests are handled by Apple. Please contact Apple Support or visit reportaproblem.apple.com. We do not control or process App Store refunds.

For web subscriptions, contact us at support@calftrackerpro.com to discuss refund eligibility. Refunds are granted at our discretion and are not guaranteed.

6. Your Account

To use the Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account at support@calftrackerpro.com
• Providing accurate and current account information

You may not share your account with others or allow multiple users to access the Service under a single subscription unless authorized multi-user access is part of your plan.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulations
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools (bots, scrapers, crawlers) to access or collect data from the Service
• Transmit viruses, malware, or any other harmful code
• Interfere with the normal operation of the Service or other users' access to it
• Resell, sublicense, or commercialize access to the Service without our prior written consent

8. Your Data

You retain ownership of all herd records, operational logs, and other data you enter into the Service ("Your Data"). By using the Service, you grant us a limited license to store, process, and display Your Data solely to provide the Service to you.

We do not sell Your Data. Your Data is used only as described in our Privacy Policy. You are responsible for the accuracy, legality, and appropriateness of Your Data.

Export availability depends on your plan. You can request deletion from within the app; shared farm records and records retained for financial or legal obligations may remain as described in the Privacy Policy and deletion notice.

9. Service Availability

We strive to maintain reliable access to the Service, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by downtime.

Supported producer records and drafts may be cached or queued on the device while offline and sync after reconnection. Uploads and some screens require internet, and sync conflicts or errors may need review. The veterinarian portal requires internet. We recommend maintaining a backup of critical records.

10. Intellectual Property

The Service, including its design, features, code, logos, and content (excluding Your Data), is owned by Calf Tracker Pro and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be error-free or uninterrupted
• Any data stored in the Service will be preserved indefinitely or without risk of loss
• The Service will meet your specific requirements

Calf Tracker Pro is a record-keeping and management tool. It is not a substitute for professional veterinary, legal, or financial advice.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Calf Tracker Pro and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service.

In no event shall our total liability to you for all claims arising out of or related to the Service exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred dollars ($100.00).

13. Indemnification

You agree to indemnify and hold harmless Calf Tracker Pro and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is otherwise harmful to other users, us, or third parties. Upon termination, your right to use the Service immediately ceases.

You may delete your account at any time from within the app. Account deletion initiates a 60-day hold period, after which your data is permanently deleted. See our Privacy Policy for full details.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Iowa, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Iowa, and you consent to personal jurisdiction in those courts.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
